1. Terms and conditions.

The apartments on NiceRent.fr (“the Apartment”) are offered for short term furnished holiday rental from NiceRent.fr (“NiceRent”) to the renter (“the Client”) under the following terms and conditions; when you book an apartment with NiceRent.fr, you are deemed to have agreed to these terms and conditions, described here below. Should you breach our Terms and Conditions, we reserve the right to terminate our agreement with you immediately and to ask you to leave the Apartment. 2. Booking process and conditions. An apartment is secured only once the required payment is paid through our on line booking system and money has been received. Bookings are taken on a first come first serve basis. Any verbal reservation without a deposit will not be taken into consideration. Upon receipt of the deposit, NiceRent will send you a confirmation statement with all the details of your reservation. This is the formal acceptance of the Apartment booking and of these Rental Conditions. Reservations can only be accepted from Clients aged 18 or over at the time of the reservation. The person in whose name the reservation is made is responsible for the payment of all rental costs and for compliance with these Rental conditions. He will also be held responsible for damage incurred by those sharing the Apartment with him. -Once you have chosen your accommodation and decided to book we ask you to send your payment through our on line booking system. -You will then receive a confirmation form with all your booking details. Including your login details so you can access the NiceRent with all your personal details and where you can input your travel details, view your booking details. -You will also receive a pre-arrival email where you will be reminded of the property address, directions, Contact person details and you will be requested to confirm your arrival details.

3. Payment terms and procedure

a. Booking process

100% of the total cost of any reservation is required to secure dates for an advertised Apartment to secure the reservation. Until the booking payment has been paid no reservation can be guaranteed.

b. Confirmation of booking

Upon receipt of the full payment, a confirmation email will be sent with full booking details and confirmation of receipt of payment. c. Methods of payment Payments can be done via major credit cards (Mastercard, VISA, American Express), Paypal or bank transfer. Fees will apply for credit card payment (2%) and PayPal payment (4%).

4. Pricing.

We have direct contracts with Apartments Owners where Owners guarantee to give us exclusivity for the rental of their Apartment and guarantee us the best prices and special offers on their Apartment. Thus we can guarantee to our Clients the best prices for the Apartments on our website. We do not charge any service fee to the Apartment prices.

a. The Apartment rental prices are in Euros and include the following:

• Use of a furnished and fully-equipped Apartment for the duration of the period specified in the confirmation email; all Apartments are privately owned, so decor, colors and inventories will of course vary. • Crockery, cutlery and electrical household appliances, • All utilities costs including cost of water, electricity, gas (if any), air conditioning (if applicable), • Local applicable taxes and service charges, • Presence of Nice Rent’s representative on arrival and departure for transfer of keys and other formalities, • 7 days a week emergency assistance by a NiceRent manager through telephone assistance between the hours of 10am – 6pm b. Prices DO NOT include the following: • Any optional services not previously specified and billed. • Client’s travel insurance, medical insurance or personal liability insurance. • Insurance for Guests personal items such as luggage, valuables or cash

c. You can order additional services at time of booking that will be added to your rental price like:

• Cleaning of the apartment upon check-out by our cleaning partner • Household linen and towels • Wifi with internet access

5. Security Deposit.

Upon arrival and leaving the Apartment, a record of the state of the Apartment and its contents will be made with your NiceRent Manager. If no record of the state of the Apartment and its content is made, the Apartment and furniture will deemed to be in good state of use. A security deposit of 150 euros is to be provided at check in and by accepting these Rental Conditions you agree to provide us with a bank check or with a valid credit card upon arrival at your Apartment. By providing your credit card details to NiceRent you are authorizing us to charge your card should this be necessary in relation to damage or loss and to apply an administration fee of 100 Euros. We are entitled to charge a card to reimburse for damage or other losses for up to 2,000 Euros. We will pre-authorize 150 Euros to your card to act as a security deposit during your stay. We will void the transaction at the end of your stay so long as the host has not reported any problems. Your credit card details will be noted by us and stored for the duration of your stay and details will then be destroyed. Damage deposits are fully refundable upon your departure, provided there is no breakage, damage, missing items.

6. Checking-in and checking out your Apartment:

The rental period shall commence 2.00pm on the first day and end at 11.00am on the last day, unless otherwise agreed with NiceRent. NiceRent shall not be obliged to offer accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated. Arrival time must be notified to your NiceRent Manager 48 hours or more prior to arrival. We are flexible for check-in until 8pm. For guest arrival at the Apartment after 8pm, there will be a 20 Euro surcharge applied and to be paid upon check-in. We cannot accept arrival at the Apartment after 11pm, and in such case the check-in will be scheduled for the following morning.

7. Cancellation Policy & Changing Bookings

The booking payment made to secure your dates is refundable in case case of cancellation. Payments that have been received to NiceRent will be refunded according to the date of the cancellation, as follows: -Cancellations 60 days or more before arrival will receive 80% refund. -Cancellations 59 days-30 days before arrival, will receive 50% refund. -Cancellations less than 30 days prior to arrival will not receive any refund. To comply with money laundering regulations our refunds can only be made by direct payment back to the credit card the monies were received from. If you need to cancel or change a reservation, you will need to send an email to NiceRent confirming the changes required. NiceRent management would then contact the guest regarding charges and cancellation fees to be applied. Should you need to change your reservation dates for the Apartment booked, you may do so subject to availability and providing that the requested changes are made at least 60 days before your arrival. In such case an administrative fee of 30 euro will be charged, and you will receive your new booking details by email. No changes are permitted within 30 days of the arrival date, in such a case our cancellation policy will apply.

8. Occupancy Rules

The maximum number of people residing in the Apartment must not exceed the number stated on the Apartment description pages on NiceRent.fr. NiceRent reserves the right to refuse service or rentals to anyone at its complete discretion. Accommodation is provided for the sole purpose of tourism and any commercial use of the Apartment is strictly forbidden. The Client certifies that he is renting the Apartment for the purpose of tourism or short term residence only. The Client agrees not to engage in any illegal, illicit, immoral or business-related activity within the Apartment. The Client agrees to be a considerate tenant and to take good care of the Apartment and to leave it in a clean and tidy condition at the end of the rental period. The Client agrees to lock Apartment’s windows and doors securely at all times when not in the premises, and must exercise care in securing all personal property. It is forbidden to fix objects to the walls and to displace furniture and appliances. For reasons of hygiene, pets are not permitted in the Apartment. The Client must respect the rules and regulations applicable to the Apartment in which his accommodation is situated: he must not be the source of excessive noise or other disruption, which might disturb neighbors, and he must respect regulations concerning the use of the communal areas of any Apartment building. Failure to behave in a proper manner with respect for neighbors and the Apartment will be considered as a breach of our Rental conditions. Should complaints be received from neighbors or should we be informed of any damage to the property you will be asked to vacate the Apartment immediately. By prior appointment (or immediately in case of emergency), NiceRent reserve the right to enter the premises at any time to ensure essential maintenance and security.

9. Advertised Apartment on NiceRent.fr

It is your sole responsibility to ensure that the Apartment advertised on our website www.nicerent.fr meets your own needs and requirements. The reviews on our website written by guests are for information only and solely describe their own personal experience in the Apartment. We cannot be held responsible for their opinion or any discrepancy with your own experience in the Apartment. All properties are exclusively managed by NiceRent and any advertisements on external advertising sites lead back to our site. We endeavor to have at all time, up to date pricing and availability calendar on our website www.nicerent.fr. We cannot be responsible for any discrepancies on any other site.

10. Unavailability caused by unseen circumstances

If the Apartment you have reserved becomes unavailable for any reason we will offer you an alternative Apartment, if available, or a full refund of the amount already paid to NiceRent. In case of mechanical, electrical or technical failures such as television, cable service, Internet connection, satellite television, appliances, air-conditioning, etc. We will endeavor to fix or replace machines as quickly as possible. Compensation will be offered at our discretion, according to the level of disappointment incurred for such failure. In case of unforeseen disruption of electricity, water or gas that we are unable to rectify within 24 hours, a refund will be offered to you and you will be required to vacate the Apartment. Where possible, you will be offered an alternative Apartment. The acceptance of these Rental Conditions means you agree that persons authorized by us may enter the property during your stay with us to carry out necessary repairs and maintenance as appropriate. We will ensure as far as possible that you are notified of their arrival and will try as far as possible to arrange visits at a time convenient to you, to respect your privacy. Whilst we will try our best to find you an alternative Apartment, we cannot guarantee that we will be able to do so. Our liability is limited to the amount you have paid to us. We will not be liable for any further claim.

11. Liabilities.

NiceRent shall not be liable for losses or events beyond its control which may interfere with your scheduled occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, terrorism, war, inclement weather, flooding, or noise coming from outside the Apartment such as private or public construction, traffic or neighbors. NO REBATE OR REFUND will be offered in these circumstances. NiceRent reserves the right to substitute comparable or better accommodations without liability, should the Apartment reserved be sold or rented long-term, be out of order, been inadvertently double-booked. If comparable Apartment is not available, Guest will receive a complete refund of all prorated rent paid for the original Apartment. NiceRent assumes neither liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their Apartment. NiceRent shall not be liable to the Client for any injury loss of limb or life of the Client, any member of the Client’s party, or any visitors of the Client to the Apartment during the rental period. It is a specific condition of this contract that the client confirms that he and all members of his party has sufficient medical insurance cover, personal injury and personal liability insurance for the duration of their stay in the Apartment. NiceRent accepts no liability for personal injury, claims or damages for your misuse of any safety systems available in the Apartment or negligence of use of stairs, balconies, terraces and wet floors or any other household hazards. NiceRent cannot be held responsible for damage incurred or loss to your personal property due to accidental damage or theft inside and outside your accommodation. Again, we recommend a fully comprehensive insurance policy. Under no circumstances shall the NiceRent’s liability to the Client exceed the amount paid to us for the rental period.

12. Privacy Policy

This Privacy Policy is intended to inform you about how we treat Personal Information that we process about you, in order to satisfy your booking requirements. If you do not agree to any part of this Privacy Policy, then we cannot provide the NiceRent.fr platform to you, and you should stop accessing our website. When you book an apartment, we collect your name, email address, mailing address, phone number and on arrival credit/debit card information. We also monitor customer traffic patterns and site use, which enables us to improve the service we provide.

We use and process Information about you for the following general purposes: • to enable you to access and use the ww.nicerent.fr website; • to operate, protect, improve and optimize our website, NiceRent business, and our users’ experience, such as to perform analytics, conduct research, and for advertising and marketing; • to help create and maintain a trusted and safer environment on our website, such as fraud detection and prevention, conducting investigations and risk assessments, verifying the address of your listings, verifying any identifications provided by you • to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you; • where we have your consent, to send you marketing and promotional messages and other information that may be of interest to you, including information sent on behalf of our business partners that we think you may find interesting. • to administer rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by NiceRent.fr; and • to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties. We do not disclose your personal information to any third parties without your prior consent.

We have implemented reasonable administrative and technical security measures to protect your Personal Information against the unauthorized access, destruction or alteration of your information. However, no method of transmission over the Internet, and no method of storing electronic information, can be 100% secure. So, we cannot guarantee the absolute security of your transmissions to us and of your Personal Information that we store.

Any violation of the above terms and conditions will lead to immediate termination of the rental agreement 24 hours following a formal notice to cease such violation, issued by registered mail or by a bailiff. In such case, the Client will be required to vacate the premises immediately and with no compensation whatsoever.
